License Agreement

Welcome to our Terms of Service Guidelines. When registering or ordering service from ZeroServers.Net you, the "Customer", are required to keep up to date with changes in our policy and service guidelines.
1. Definitions a. "Customer" A person or group purchasing or about to purchase, service with Zeroservers.net.
b. "Company" The site and/or services of Zeroservers.net.
c. "Game Server" A single application process hosted on a single Internet server over the Internet for entertainment and/or recreational purposes.

2. Responsibility Guidelines

a. Company Responsibilities - We are responsible for the maintenance and uptime of the network and hardware. We will provide the Customer with hosting with 99.9% uptime, reasonable ping times and 24-hour technical support. We do not monitor game servers themselves only the hardware and network they are hosted from. We do occasionally monitor servers causing overly excessive CPU usage. We restrict the use of game mod's that are unstable and cause unstable CPU usage affecting the overall performance of the server we will send warning notifications if you exceed normal paramaters for cpu usage. We reserve the right to terminate servers for exceeding acceptable cpu usage on a continuous basis.

b. Customer Responsibilities - You are responsible for the upkeep of your server. If your server is down you are required to notify us as soon as possible via a support ticket found on our web interface to make sure your game server is back online, since we don't monitor game servers on an individual basis. You must notify us if your server is experiencing problems or your server is down through our support area of our web site. We want to help limit the amount of downtime you may experience due to server crashes etc. We only monitor our computer systems to ensure all systems running game servers stay up 24 hours a day 365 days a year. We restrict the use of game mod's that are unstable and cause unstable CPU usage affecting the overall performance of the server. If you are caught running something that this occurs; you will be notified to look into this. If this continually occurs you will be notified to correct the issue or your server will be terminated with no refund. If you server is going to be down for any period of time for maintenance you will be notified. You must insure that your server abides by our term of service at all times.If we Receive Any Filing of Complaint disputes without us having time to look into any problems about service within the first week of purchase through any organization whether it be Paypal or any other outside organization your server will be terminated and you will forfeit any funds payed. Your game server must stay compliant with our Terms of Service at all times.
c. Paying for service - All payments are due before service is rendered. A service month is 30 days; if you have paid for service for 3 months then you have 90 days of service. Service payments are expected on or before your next bill date. You will be emailed a bill beforehand. If you no longer require service we require you to notify us by email. There are no refunds for unused service. You are required to cancel your server 7 days prior to the end of your billing date if you do not wish to keep your server failure to due so will result in a 10.00 non-cancellation fee. All non paid bills are sent to a collection agency after 14 business days.

d. Player Limits - To provide everyone with a value dedicated game server there are limits on the number of players based on the service you applied for. While we don't monitor our service on a daily basis we do reserve the right to inspect any game server to insure they are not exceeding the current max player limit allowed for that account. Violations will result you receving a warning continous violations of this will result in yourr server being immediately eliminated with no refund. We have no tolerance for this. Although we are aware installing some game mods my cause this to occur initially until you setup so we do give a 30-minute window that would allow you to do this. Bots in game servers - We understand how some people enjoy running bots on there servers. However bots do take extra server resources when the server is not in use. We do allow bots to run on our game servers we host. But we do ask that you do not do this excessively. If it is it may cause your server to cause excessive CPU usage as mentioned in the Customer Responsibilities above

3. FTP Access Guidelines

a. Server Files - FTP access is not to be used to run a file site or for file storing. All users of our service are responsible for their files and content of their servers. Game Server installs come as a basic setup. The customer must apply additional files and add-ons. Anytime you make changes to your files please test those changes on your local computer system first. Please change your files with care. We are not responsible for the files in your game server directories after your game server account is activated. There will be no storing of porn, warez, or other illegal files on the game server's FTP or Web hosting Space. If caught, you will be warned before termination.
b. File Space Limits - There is a 1GB file limit per server in addition to default size for maps, mods, plugins, sounds etc. We reserve the right to delete information from your game install if your directory size goes over 3GB including the game install and log files.

4. Payments and Paying for Service

a. Payment Processing - All payment collection is done through us.
b. Payment Forms Accepted - We accept payment via Visa, MasterCard, American Express via PayPal.
c. Payment via Credit Card -When paying with a credit card you will be issued a PayPal bill. We can also provide you a PayPal subscription upon request as we have had several people ask for convenience.
d. Payment Terms - A billing month is based on a 30-day period. All service payments must be made before service is rendered. Payment for service beyond your first payment must be made on or before you next billing date. If at any time you have questions about when your next bill is due you may e-mail or call the staff of this site. Servers must be cancelled 7 days in advance. Failure to do so is a 10.00 dollar cancellation charge. You may also incure a 10.00 late payment fee if your bill is not payed by the due date. If Server payment is made late without paying to late fee your serverss billing date will be prorated to an earlier date to compensate for the late payment.
e. Account System - On this site we use our own account system. This system manages all billing functions for your account. All service is deducted from your online account shortly after it's collected. You are responsible for keeping your online account balance on or above a $0.00 balance.
f. Service Changes - You may change, upgrade or downgrade your service at anytime. Additional fees may apply for service upgrades if you are upgrading service in the middle of your current billing cycle.
g. Canceling Service - You are required to cancel your server 7 days prior to the end of your billing date if you do not wish to keep your server failure to due so will result in a 10.00 non-cancellation fee. All non paid bills are sent to a collection agency after 14 business days.

5. Service Level Agreement and Refund Policies

a. Refunds - We offer Refunds Only if the servers cannot be set up for unexpected reasons. There will be no refunds issued if your account is terminated for violations of terms of service.. There will be No credit for early termination unless within the 72 hours initial period.
b. Service Credits - We will credit your account if your server is down for a period of time of more then 8 hours in any given day due to hardware or network issues. Credits will be determined by our staff at the time of the issue and will be credited directly to your online account once the issue is resolved. Service credits may not be paid in cash, or refunded to credit cards.
c. 3 Day Change your mind Policy If for whatever reason you do not wish to keep your service with us you can request a refund for service if within your first 72 hours of service. This does not include setup fees.

6. Additional Terms

a. Pricing Subject to Change - Prices are subject to change with little or no notice at anytime. Your fee will never be raised at anytime you will always have the fee you signed up with.
b. Upgrades and Patches - We will patch your server as needed by the game designers at no charge to you. There may be a slight down time while doing this you will be notified when it will occur. We recommend that you back up your files from the ftp before requesting a patch in case something is not compatible and needs a reinstall.
c. Failure to Comply - Failure to comply with all current and future Terms of Service Agreements can result in termination of your account and/or service interruption. We reserve the right to discontinue your service if a server if we find your server is in violation of our Terms of Service, until the account holder insures us his/her game server does comply with our Terms of Service. If service termination is in order your service can be terminated without refund. If you have questions about our TOS please send an e-mail to admin@zeroservers.net.

7. IRC Policy

No Irc connections from gameservers to irc servers in any circumstances
NO IRC PERIOD!!!!
Liability:
IN NO EVENT WILL ZeroServers.net BE LIABLE TO CUSTOMER FOR ANY CONSEQUENTIAL, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL DAMAGES OR ANY LOSS OF PROFIT, REVENUE, DATA OR GOODWILL WHETHER INCURRED OR SUFFERED AS A RESULT OF UNAVAILABILITY OF THE SERVICES, PERFORMANCE, NONPERFORMANCE, NEGLIGENCE, TERMINATION, BREACH OR ACTION OR INACTION UNDER THIS AGREEMENT EVEN IF CLIENT ADVISES ZeroServers.net OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. THE FOREGOING LIMITATION ON LIABILITY, HOWEVER, SHALL NOT RELIEVE ZeroServers.net FROM LIABILITY FOR DIRECT DAMAGES ARISING SOLELY OUT OF ZeroServers.net GROSS NEGLIGENCE OR WANTON OR WILLFUL MISCONDUCT IN PERFORMANCE OF THE HOSTING SERVICES.
